Texas Sues Feds Over Syrian Refugees
Yesterday, Texas filed a suit in federal district court in Dallas. The complaint is here. Texas seeks declaratory and injunctive relief and the requirement of consultation and cooperation in the resettlement of refugees in the state of Texas.
Dan Kowalski on LEXIS/NEXIS Legal Newsroom: Immigration Law opines that “This lawsuit is a political stunt doomed to failure. The U.S. Supreme Court made it clear that lawfully admitted aliens (including refugees) may live in any state; Truax v. Raich, 239 U.S. 33 (1915). And the Texas Constitution guarantees equal protection of law regardless of national origin; Article 1, Section 3a.” For further details on the lawsuit, click here.
