Biden Administration Proposes Changes to the H-1B Program

On October 20, the Biden administration proposed changes to the H-1B visa program, a visa category which permits high-tech businesses to sponsor foreign workers to work in the United States. The proposed rule was published in the Federal Register on October 23. Although the proposed rule would not alter the 60,000 per year cap on the program, it would discourage companies from making multiple registrations for an individual by permitting only one entry per candidate into the visa lottery for the program, reducing fraud in the program. It also would make it easier for foreign students to enter the program and loosen eligibility requirements for rising entrepreneurs. The proposed changes are partially in response to recent changes to Canada’s program, which allows workers to apply for permanent residency, and has lured workers away from the US program.
