Hazleton Files Notice of Appeal
On Thursday, the City of Hazleton, Pennsylvania, filed a notice of appeal in Lozano v. City of Hazleton, in which the district judge in July ruled that the City’s “Illegal Immigration Relief Act” was preempted by federal law. The Notice of Appeal identified several grounds for the appeal. The city is not only appealing the decision to strike down the ordinance but some pre-trial rulings, most notably the decision to let several undocumented immigrant plaintiffs maintain their anonymity (a relatively common practice, see, e.g., Plyer v. Doe (1982) in cases involving undocumented immigrants) . It seems to me that the city should focus on the preemption issue.
