Transcript to Supreme Court Oral Argument in Dada v. Mukasey

The transcript of today’s argument in Dada v. Mukasey (06-1181), along with materials on the case, is now available on scotusblog.  The issue in the case is whether a noncitizen’s timely filing of a motion to reopen removal proceedings should automatically toll a previously granted order of voluntary departure.  The Court grated cert to resolve a split in the circuits.  Christopher Meade argued for the petitioner, and Edwin Kneedler of the Solicitor General’s office argue for the government.   In my view, the questioning was rigororous for both attorneys, although several Justices, especially Chief Justice Roberts, seemed particularly concerned with untoward delays of removals by tolling an order of voluntary departure pending a decision on a mpotion to reopen.
