Breaking: Federal Court Enjoins Executive Order Provision re Funding for Sanctuary Cities

Federal district court judge William H. Orrick (N.D. Cal.) has issued an order granting the County of Santa Clara and City of San Francisco’s motions for a preliminary injunction, preventing Section 9(a) of Trump’s January 25, 2017 Immigration Executive Order regarding the denial of federal funding for sanctuary jurisdictions from going into effect.  The order finds a likelihood of success on the merits with respect to all of the substantive violations by the plaintiffs: (1) separation of powers, (2) Tenth Amendment, (3) void for vagueness, and (4) procedural due process.
