Update from JGG v. Trump (Alien Enemies Act case)
Today, Judge Boasberg (D.D.C.) denied the Trump administration’s motion to vacate the temporary restraining orders that prohibit the Government removing the named Plaintiffs or any other Venezuelan noncitizens in its custody solely on the basis of the Trump proclamation resting on the Alien Enemies Act.
The Court noted that–quite aside from whether the president could use the Alien Enemies Act in this way–that the individuals being renditioned have a due process right to question whether they are, in fact, “alien enemies” at all.
