SCOTUS: Monsalvo Velázquez v. Bondi
Today, the Supreme Court issued its opinion in the case of Monsalvo Velázquez v. Bondi. In a 5-4 decision, the Court held that under 8 USC §1229c(b)(2)–INA 240B–a voluntary-departure deadline that falls on a weekend or legal holiday extends to the next business day. This means that Monsalvo Velázquez’s motion to reopen was timely when it was filed on the Monday following the 60th day of his voluntary departure period when that 60th day landed on a Saturday.
