Federal Court Blocks President Trump from stripping Temporary Protected Status from Venezuelans, Haitians

 

Kyle Cheney and Josh Gerstein for Politico report that a federal court entered summary judgment and has barred the Trump administration from revoking the temporary protected status (TPS) for hundreds of thousands of Venezuelan and Haitian noncitizens, finding the administration’s effort to lift that status to be arbitrary and capricious in violation of the Administrative Procedure Act.

U.S. District Judge Edward Chen held that Homeland Security Secretary Kristi Noem’s move to terminate TPS afforded by the Biden administration was “preordained without any [meaningful] analysis and review.”
