Ellen Dannin on Hoffman Plastics

Ellen Dannin (Penn State) writes the following about Hoffman Plastics, Inc. v. NLRB (2002), the Supreme Court decision that advocates of immigrant workers love to hate:  “the sad truth is, that rather than creating an injury unique to immigrants, Hoffman Plastics is better seen as part of the long American tradition of judicial hostility toward unions and labor law with roots in the 1930s and even earlier.”   In Hoffman Plastics, the Supreme Court held that an employer that illegally fires an undocumented worker is not liable for back pay for violations of the National Labor Relations Act.

I am not sure that it makes me feel any better to see that the Supreme Court is anti-worker and anti-labor as well as anti-immigrant!
