Former HLS Dean Nominated to SCOTUS

As everyone knows, President Obama has nominated former Harvard Law School dean and current Solicitor General Elena Kagan to the U.S. Supreme Court.  It is hard to know Kagan’s views on immigration matters.  However, Kagan as Solicitor General agreed with the noncitizen petitioner that the federal courts could review denial a motion to reopen in Kucana v Holder.  The Court vindicated Kagan’s decision earlier this year in ruling in favor of judicial review.
