Tell the Truth About Arizona’s Immigration Law, Kris Kobach!

Media darling and anti-immigrant zealot Kris Kobach seems to be everywhere anti-immigrant foment is brewing (or campaigning in his bid to become Kansas Secretary of State) .  His claim that the Arizona immigration law simply mirrors federal law is seriously misleading, as Stephen Lemons correctly points out.  As a law professor, Kobach should know better.  Rather than muddying the waters and attempting to confuse the issues, he should squarely address the true constitutional challenge to the Arizona law — that the federal government has exclusive authority to regulate immigration and the state of Arizona cannot enlist state and local police in enforcing federal immigration law.  This argument led a federal court to invalidate California’s Proposition 187.
