Irony of the Day: Alabama Constitution Provides “That immigration shall be encouraged; emigration shall not be prohibited, and no citizen shall be exiled”

Section 30 of Article I of the Alabama State Constitution states as follows:

“Immigration, emigration and exile.

That immigration shall be encouraged; emigration shall not be prohibited, and no citizen shall be exiled.”

This makes Alabama’s tough-as-nails immigration law all the more vulnerable legal challenge.  As we reported yesterday, the U.S. government sued yesterday to invalidate the law on federal preemption grounds.  A separate lawsuit challenging the Alabama immigration law has been filed for violating the Alabama Constitution.
