Supremes Hear Oral Arguments in Kawashima v. Holder and the immigration consequences of filing a false tax return

Kevin Russell on SCOTUSblog has a recap of the oral argument yesterday in the U.S. Supreme Court in Kawashima v. Holder, a case involving the immigration consequences of filing a false tax return. As explained in our argument preview, the question in the case is whether filing a false tax return counts as an “aggravated felony” for purposes of a statute that subjects an immigrant convicted of an “aggravated felony” to deportation. The statute defines “aggravated felony” to include any offense that “(i) involves fraud or deceit in which the loss to the victim or victims exceeds $10,000; or (ii) is described in section 7201 of title 26 (relating to tax evasion) in which the revenue loss to the government exceeds $10,000.”
