Obama’s Prosecutorial Discretion Initiatives in Jeopardy? Federal Court Says Yes

In a lawsuit championed by Kris Kobach, a district court has indicated that a challenge by U.S. immigration agents to the use of prosecutorial discretion by the Obama administration (which would semingly apply to the Deferred Action for Childhood Arrivals program) will probably succeed. U.S. District Judge Reed O’Connor yesterday put off his own decision on whether to grant the request for a preliminary injunction by U.S. Immigration and Customs Enforcement agents. He asked both sides to provide additional briefing by May 6.
