A Response to Alberto Gonzales on Same Sex Marriage under the Immigration Laws
Gary Endelman and Cyrus D. Mehtacomment on the argument by former Attorney General Alberto Gonzales and David Strange in an op/ed in the New York Times that the Supreme Court’s decision in United States v. Windsor, 133 S. Ct. 2675 (2013), which struck down section 3 of the Defense of Marriage Act (DOMA) as unconstitutional, does not make it clear that sex spouses may be entitled to immigration benefits under the Immigration and Nationality Act. The Obama administration, including the BIA, disagrees with Gonzales and Strange.
