ICE Officers, Kris Kobach Challenge to DACA Dismissed

Julia Preston of the New York Times reports on the U.S. district court ruling yesterday dismissing a lawsuit by immigration officers seeking to halt the Deferred Action for Childhood Arrivals (DACA) program, Judge Reed O’Connor concluded that his court did not have jurisdiction to decide the suit it was an administrative dispute between federal employees and the government. The outcome was somewhat surprising because Judge O’Connor in an earlier ruling had said he agreed with the argument that DACA violated federal law.

The lawsuit was brought by Chris Crane, an officer who leads the union of enforcement agents and has been critical of the Obama administration’s enforcement record. One lawyer for the agents is Kris W. Kobach, Secretary of State of Kansas, and who has guided many — including many unsuccessful — lawsuits seeking to restrict immigration.
