Ninth Circuit Holds that Arizona Cannot Deny Driver’s License to DACA Recipients

In Arizona Dream Act Coalition v. Brewer, the U.S. Court of Appeals in an opinion by Judge Harry Pregerson, and joined by Judges Marsha Berzon and Morgan Christen, held that the state of Arizona could not deny driver’s license to recipients of relief under the Deferred Action for Childhood Arrivals (DACA) program.  The Ninth Circuit affirmed a permanent injunction blocking former Governor Jan Brewer’s executive order that denied driver’s licenses to undocumented immigrants who had secured DACA relief.  U.S. District Court Judge David G. Campbell issued the permanent injunction in January 2015, a month after he granted a preliminary injunction and ordered Arizona to begin allowing DACA recipients to apply for driver’s licenses
