Supreme Court to Hear Oral Argument in Lynch v. Morales-Santana: A Preview

On Wednesday, the Supreme Court will hear oral arguments in Lynch v. Morales-Santana, a case that considers the lawfulness of gender distinctions in derivative citizenship laws.  The Second Circuit struck down the gender distinctions.  The last time that the Court considered the issue was in Flores-Villar v. United States (2011), with the Court equally divided (and Justice Kagan recusing herself).  Amy Howe previews the oral arguments for SCOTUSBlog here.  She suggests that the U.S. government has an uphill battle before it.
