Potential DHS Secretary: Constitutional Amendment Not Necessary to End Birthright Citizenship

Laura Powers for Newsweek reports that potential nominee to head the Department of Homeland Security Ken Cuccinelli, now acting director of U.S. Citizenship and Immigration Services, said yesterday that “ending birthright citizenship does not need a Constitutional amendment. `I do not think you need an amendment to the Constitution. I think the question is do you need congressional action or can the executive act on their own,’ Cuccinelli said during a breakfast event hosted by Christian Science Monitor.” 

Legal scholars generally agree that birthright citizenship is mandated by the 14th Amendment of the U.S. Constitution.

Cuccinelli appears to be on the same page as President Trump.  Birthright citizenship has been a topic of debate throughout the Trump presidency. Last August, President Trump told reporters that his administration was “very seriously” looking at birthright citizenship, which he said was “frankly ridiculous.”  He previously claimed that he intended to end birthright citizenship through an executive order.
