Challenge to Ending of TPS Remains Before the Ninth Circuit
The Trump administration’s many immigration measures have included attempts to end Temporary Protected Status (TPS) for Salvadorans, Nicaraguans, Hondurans, Haitians, and others. President Trump also reportedly stated that noncitizens from “s—hole countries” should not be entitled to relief from removal from the United States.
Farida Jhabvala Romero for KQED reports on the status of a lawsuit challenging the administration’s efforts.
Crista Ramos, a 16 year old U.S. citizen, is the lead plaintiff in the class-action lawsuit, Ramos v. Nielsen, aiming to stop the Trump administration from ending TPS for more than 400,000 noncitizens nationwide, including Ramos’ mother.
The case, which raises Administrative Procedure Act and constitutional claims, is currently before the U.S. Court of Appeals for the Ninth Circuit. The court is reviewing a district court injunction blocking the administration from ending TPS.
The case was argued last August. The panel includes U.S. Circuit Judges Consuelo Callahan, Morgan Christen, and Ryan D. Nelson.
