Lawsuit: DOJ’s ‘Prior Restraint’ Rule Allegedly Silencing Immigration Judges Violates First Amendment

The Trump administration has taken steps that allegedly undermine the independence of the nation’s immigration judges.  And the judges are pushing back.  Here is the latest.

The National Association of Immigration Judges (NAIJ) has sued the Trump administration over a policy that prohibits immigration judges from speaking in their personal capacities about immigration law or policies.

The lawsuit, filed by the Knight First Amendment Institute at Columbia Universityin the U.S. District Court for the Eastern District of Virginia, claims that the restrictions impose an unconstitutional system of prior restraint on the judges’ speech. A copy of the complaint can be found here.
