7th Circuit Denies Texas’ Bid To Revive Public Charge Rule

Alyssa Aquino for Law360 (registration required) reports that the U.S. Court of Appeals for the Seventh Circuit yesterday rejected an attempt by 14 states led by Texas to revive the Trump administration’s public charge rule.

The Biden administration’s Department of Homeland Security had stated that it would no longer defend the Trump era rule in legal challenges.

The states had asked to intervene in the lawsuit and defend the policy themselves.  Texas is represented by Judd E. Stone II of the Texas attorney general’s office.

John Kruzel for the Hill previously reported on the challenges of the states to various actions of the new administration on immigration.  Given the primacy of federal power over immigration, it will be difficult for the states to put a halt to many federal immigration initiatives.
