Title 42 Termination Spurs Democratic Senator Concerns

The Title 42 order allowing for immediate expulsions at the U.S./Mexico border appears on its way out.  But some Democratic leaders apparently are nervous.

Micah Danney for Law360 (Listen to article) reports that four Democratic senators pressed the U.S. Department of Homeland Security to answer questions about managing the expected increase in migrants crossing the southern border, in the wake of a district court’s December 21 deadline to end the Title 42 policy of swiftly expelling migrants.

In a letter to DHS Secretary Alejandro Mayorkas, Kyrsten Sinema and Mark Kelly of Arizona, Jon Tester of Montana and Maggie Hassan of New Hampshire posed nine questions to the department on its preparedness to process and transport migrants in shelters, and to reimburse nongovernmental organizations that provide food and shelter.

The language of the letter is direct:  “Border communities continue to bear the brunt of Washington’s failure. While Border Patrol attempts to release migrants to NGOs, this is not always feasible,” the senators wrote.
