United States v. Texas, Explained

United States v. Texas probably was the biggest immigration decision of the Supreme Court’s 2022 Term.  In that case, the Court held that Texas and Louisiana could not challenge the Biden administration’s Department of Homeland Security’s Guidelines for the Enforcement of Civil Immigration Law.  Writing for the majority, Justice Kavanaugh emphasized that “[t]he States have brought an extraordinarily unusual lawsuit. They want a federal court to order the Executive Branch to alter its arrest policies so as to make more arrests. Federal courts have not traditionally entertained that kind of lawsuit; indeed, the States cite no precedent for a lawsuit like this.”
