SCOTUS Freezes SB 4
The twists and turns in the SB4 litigation keep on coming. Here’s a brief recap:
- On Thursday, U.S. District Court Judge David Alan Ezra enjoined the state of Texas from enforcing SB4. (Here is the 114-page order.)
- On Saturday, the 5th Circuit granted a stay of the trial court’s decision, but put its ruling on hold for seven days, allowing time for the Biden administration to go to the Supreme Court. (Here is that opinion.)
- Today, the Biden Administration “rushed” to the Supreme Court to review the 5th Circuit stay. (Here is their brief.)
- Today, Justice Alito “administratively stayed” the 5th Circuit decision, blocking SB4 from going into effect until (for now, at least) March 13 and requesting briefing from Texas due March 11. (Here is the administrative stay.)
