White House: “RESTRICTING THE ENTRY OF FOREIGN NATIONALS TO PROTECT THE UNITED STATES FROM FOREIGN TERRORISTS AND OTHER NATIONAL SECURITY AND PUBLIC SAFETY THREATS”

 

 

As long expected, the White House has issued a new, if not improved, travel ban.  Here is the White House proclamation.  It is detailed and rather lengthy.  The litigation experience with the original Muslim ban in President Trump’s first term unquestionably influence the care and detail in the drafting of this travel ban.

As NPR reports, President Trump’s “proclamation bans travelers from 12 countries and partially restricts travelers from several others, effective June 9. The White House stated that this action is necessary to protect the United States from terrorist attacks and other national security threats.”

A complete ban applies to foreign nationals from

Afghanistan

Burma (Myanmar)

Chad

Republic of the Congo

Equatorial Guinea

Eritrea

Haiti

Iran

Libya

Somalia

Sudan

Yemen

This travel ban is more expansive than the one the president enacted in his first term, NPR’s Franco Ordoñez tells Up First. During his first term, Trump called for the “total and complete shutdown of Muslims entering the United States.” Courts blocked the first ban in legal challenges. After repeated revisions, the Supreme Court approved the third version in Trump v. Hawaii (2018). Former President Biden lifted the ban on his first day in office.

In a video released on social media, Trump tied the new ban to the terror attack in Boulder, Colorado, saying it showed the dangers posed by some visitors who overstay visas. The suspect in the attack is from Egypt, which is is not on the travel ban list.

Expect litigation to follow.
