Supreme Court Allows Lower Court Injunction Barring Implementation of Florida Immigration Law
Amy Howe for SCOTSBlog reports today that “the Supreme Court denied Florida’s request to enforce a state law making it a crime for persons to enter the country illegally or remain in that state. The court provided no explanation for its decision, which consisted of a one-sentence order.” The order states in full: “The application for stay presented to Justice Thomas and by him referred to the Court is denied.”
As the Associated Press reports, the Court’s order “will keep the law on hold while a legal challenge [to the Florida law] continues. . . . Florida Gov. Ron DeSantis signed the legislation into law in February . . . .”
Immigrants rights groups filed lawsuits, arguing that the Florida law is preempted by federal law. Earlier this week, a court of appeals reached a similar conclusion with respect to a Texas immigration enforcement law.
