Supreme Court to Review Asylum Case

Amy Howe for SCOTUSBlog reports that the Supreme Court granted certiorari in Urias-Orellana v. Bondi.   “[T]the justices will decide how much deference courts of appeals should give to a determination by the Board of Immigration Appeals that an individual seeking asylum has not been persecuted. The Trump administration agreed in this case that the Supreme Court should grant review to resolve confusion in the courts of appeals about the proper standard of review.”  The issue in the case is “[w]hether a federal court of appeals must defer to the Board of Immigration Appeals’ judgment that a given set of undisputed facts does not demonstrate mistreatment severe enough to constitute “persecution” under 8 U.S.C. § 1101(a)(42).”
